A. What is a trademark?

A trademark is a word or symbol that indicates the origin of goods, allowing consumers to identify the company that is ultimately responsible for a particular product. A trademark is more likely to get more customers' attention because of its popularity and guaranteed quality.

For example, when consumers see the BMW brand on a car, this Trademark will influence their emotions, technical judgment, comfort and enjoyment of driving this car. The relationship between the brand (BMW's car) and the concept of product quality (luxury, power, excellent engineering) results in high value in the market.

Therefore, companies invest a great deal of time, money and effort in developing the exclusive brand mark for their products because it brings significant impact on their revenue, its reputation and brand awareness. The value itself is something that lots brands work hard to protect.

B. What are trademark rights?

The concept behind trademark rights is that the owner of the mark has the legal right to stop people from trading off of the value of the company’s brand and reputation. They can do so by stopping the use of any confusingly similar trademark.

For instance, if an unknown car company wants to use the mark BMW to identify their new car, the BMW company will be able to stop them from doing so based on the similarity of the marks themselves and the goods they are used to identify. Often trademark owners will also secure rights in other related goods that they want to sell . For example, if you sell BMW T-shirts, you are in breach of trademark rights even though BMW does not sell T-shirts!

C. What is trademark policy?

Merchants are not allowed to use third party trademarks unless they have permission from legal owners.

In other words, for designs with copyrighted images, your orders would only be sent to process in our partners' factories if you provide us the license proving your rights to print these images.

By using ShopBase with PrintBase package and opting into our Terms of Service, you are stating that you are authorized to manufacture products with that design and would take full responsibilities for the use of the products/artworks.

If we recognize any campaign that violates our trademark policy, infringing products would be deleted and its orders would be cancelled.

You can learn more about our Trademark Policy, and refer to Blacklist Trademarks for a list of frequently reported trademarks.

The Blacklist Trademark list is only for reference purpose. The use of trademarks in your products on ShopBase (whether or not in this list) without permissions may lead to legal risks.
